These Terms of Service govern use of Social Posting by Winning Funnel, operated by Winning Funnel (also branded as WinningFunnel). By using the service, you agree to these terms on your own behalf and, if applicable, on behalf of the business you are authorized to represent.
1. The service
The service supports authorized social-media publishing, advertising management, and performance reporting using Meta and related business integrations. Access may be provided as a managed service or through connected software such as Estate Engine. Features depend on the specific implementation, platform availability, permissions, and services agreed with your business. A feature described in these terms is not a promise that it is enabled for every user.
2. Eligibility and account authority
You must be at least 18 years old and have authority to use the accounts, Pages, business assets, and content you connect or submit. You must provide accurate information, maintain appropriate access rights, and promptly tell us if your authority changes or you suspect unauthorized access.
You are responsible for your platform accounts and for the instructions given by users you authorize. Do not share passwords or access tokens through public content or ordinary support messages.
3. Instructions, approvals, and advertising spend
You authorize Winning Funnel and the app to perform actions that you request, approve, or configure, within the permissions you grant. These may include publishing content, creating or changing advertisements, retrieving reports, and transferring leads to a connected CRM where enabled.
Granting an API permission is not by itself approval for an unlimited advertising budget. Campaign budgets, launch instructions, and any ongoing management authority must be agreed or configured separately. You are responsible for reviewing and authorizing the content, audience, budget, schedule, and destination appropriate to your campaign before launch.
Live advertisements can incur charges until they are paused, ended, or otherwise stopped on the platform. Disconnecting this app does not necessarily stop an advertisement already running. You retain responsibility for checking the status and billing of your ad accounts.
4. Content ownership and permission
You retain your rights in content you own. You grant us a limited, non-exclusive right to store, process, adapt, transmit, and publish the content you provide only as needed to deliver the services you authorize. You confirm that you have the necessary rights and permissions for the content, including photographs, likenesses, voices, music, trademarks, and personal information.
AI-assisted drafts and creative assets require human review. You are responsible for checking accuracy, spelling, claims, required disclosures, and suitability before approving publication. The service does not guarantee that generated content is accurate, unique, free of third-party rights, or accepted by an advertising platform.
5. Acceptable use
You may not use the service to violate applicable law or platform rules; impersonate others or misrepresent authority; publish deceptive or unlawful content; infringe intellectual-property or privacy rights; send unauthorized spam; access another party’s information without permission; or bypass access restrictions, security controls, or review requirements.
You are responsible for obtaining required consents and providing appropriate privacy notices when collecting or using leads and customer information. Marketing materials concerning regulated services must receive the review appropriate to those services. Our software and content assistance are not a substitute for professional legal, financial, or other regulated advice.
6. Third-party platforms and fees
Facebook, Instagram, and other connected services are operated by third parties. Their terms, advertising rules, account restrictions, and charges also apply. Social Posting by Winning Funnel is an independent service and is not sponsored, endorsed, or operated by Meta.
Meta advertising spend and other third-party charges are separate from Winning Funnel’s service fees unless your written agreement expressly says otherwise. Service pricing and payment terms are governed by the applicable proposal, order, or service agreement; these terms do not create a new subscription or authorize a charge by themselves.
7. Privacy and data
Our Privacy Policy explains what information we process and why. Our data-deletion instructions explain how to revoke access and request deletion of information held by us. You are responsible for keeping any independent copies of your own materials that you need.
8. Availability and limitations
We work to maintain the service, but APIs, permissions, reviews, and third-party systems can change or become unavailable. We do not guarantee uninterrupted access, publication at an exact time, ad approval, or any particular level of reach, leads, revenue, or other business results.
Except for commitments in a separate written agreement and rights that cannot be excluded by law, the service is provided as available, without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. To the extent permitted by law, Winning Funnel is not liable for indirect or consequential losses arising from use of the service. Nothing in these terms excludes liability or rights that cannot lawfully be excluded.
9. Suspension, termination, and changes
You may stop using the service and revoke platform permissions at any time. Contact us about ending any separate paid service agreement. We may suspend or restrict access where reasonably necessary to address unauthorized use, a security risk, a violation of these terms, or a platform or legal requirement.
Ending access does not automatically delete posts, stop advertisements, or erase records on third-party platforms. Data held by us is handled under our Privacy Policy and deletion process. We may update these terms by posting a revised version and effective date, with additional notice when required. Changes apply prospectively, subject to applicable law and any separate written agreement.
